DEVELOPER Rosecorp is considering applying to the NSW Licensing Court to advance its plans for the first stage of a $300 million development at Catherine Hill Bay.

Rosecorp managing director Stuart Rose said yesterday the company was "weighing up all our options".

Mr Rose said the planned development would enable the bay's historic coal-loader jetty to be retained.

"If we can't go ahead with the development and have to do something entirely different, the jetty will have to go," he said. "We want to retain the heritage of Catherine Hill Bay."

As reported in The Herald yesterday, the Land and Environment Court rejected Rosecorp's arguments of "existing use" for the development to proceed.

Justice Robert Talbot found the company could apply to the Licensing Court to build housing as part of a club.

If the Licensing Court rules that Rosecorp can have housing with a club, the company would have to return to the Land and Environment Court for approval.

The company plans to build 96 terraced apartments from two to five storeys on a former colliery site that overlooks the Pacific Ocean.

Justice Talbot believed that was contrary to the way clubs were expected to be managed.
